Spouse Visa

Citizenship and Immigration Canada (CIC) knows it is important to help families who come from other countries to reunite in Canada. If you are a Canadian citizen or a permanent resident of Canada, you can sponsor your spouse, common-law partner, conjugal partner, dependent child (including adopted child) or other eligible relative (such as a parent or grandparent) to become a permanent resident.CIC refers to the immigrants who are eligible to use this family sponsoring process as the Family Class.

If you become a permanent resident, you can live, study and work in Canada. For more information about being a permanent resident in Canada, see the Related Links section at the bottom of this page.

When you arrive in Canada as a permanent resident, you must make every reasonable effort to provide for your own essential needs and those of your family.

If you sponsor a relative to come to Canada as a permanent resident, you are responsible for supporting your relative financially when he or she arrives. As a sponsor, you must make sure your spouse or relative does not need to seek financial assistance from the government.
The process to sponsor your family begins when you, as a citizen or permanent resident in Canada, apply to be a sponsor.

There are two different processes for sponsoring your family. One process is used for sponsoring your spouse, conjugal or common-law partner and/or dependent children. Another process is used to sponsor other eligible relatives.

1. Overview of Canada Spouse Visa
If you are a citizen or permanent resident of Canada, you can sponsor your Spouse or Dependent Children to Immigrate to Canada.
Note: Effective December 22, 2014, eligible spouses or common-law partners have the opportunity to work in Canada while they wait for their application for permanent residence to be processed.
Citizenship and Immigration Canada (CIC) will issue open work permits to certain spouses or common-law partners who are applying for permanent residence from inside Canada, before the approval in principle decision on their application is made.
2. Eligibility for Canada Spouse Visa:

If you sponsor a family member to immigrate to Canada, you must provide proof that you can:
. meet basic needs—such as food, clothing and shelter—for yourself and your family,

3. How Visa Office Access your Application:

A) If your Application is Approved

That office will tell you in writing if you have been approved to be a sponsor. It will also tell you which visa office will process the application.

B) If your Application is Rejected:
If Visa office do not approve you as a sponsor, your relative may still apply for permanent residence.
If they approve you as a sponsor but do not approve the relative you want to sponsor, they will tell you why we refused them. They will also tell you about your right to appeal this decision.

You may withdraw your application at any point in the process before the relative you sponsor becomes a permanent resident of Canada. They may refund the fees for either application if we have not started to process it. Contact Citizenship and Immigration Canada (CIC) if you want to withdraw an application.
